AGREEMENT TO TERMS​

 

These Terms of Use (“Terms”) govern your access to and use of the Hitmaker Song Lab website, mentorship programs, audition process, online services, content, and related materials (collectively, the “Services”).


These Terms constitute a legally binding agreement between you (“you,” “participant,” “user,” “parent,” or “guardian,” where applicable) and Hitmaker Song Lab (“Company,” “we,” “us,” or “our”).


By accessing or using our website, submitting an audition, participating in mentorship sessions, enrolling in a program, or otherwise engaging with our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.


If you do not agree to these Terms, you must discontinue use of the website and Services immediately.


Additional policies, agreements, and program-specific documents — including the Enrollment & Participation Guide, Finance Policy, Privacy Policy, and any other supplemental terms — are incorporated into these Terms by reference and form part of this agreement.


We reserve the right to modify or update these Terms at any time. Continued use of the website or Services following changes constitutes acceptance of the revised Terms.

PROGRAM PURPOSE AND ELIGIBILITY​

 

Hitmaker Song Lab is an independent songwriting mentorship and music education program .


The program provides educational mentorship in songwriting, creativity, music development, artistic growth, and related creative disciplines.


Participation in Hitmaker Song Lab does not constitute employment, artist management, entertainment representation, talent agency services, legal representation, or guaranteed professional placement.


Participants Age 18+
Participants aged 18 years or older may enroll independently and are responsible for compliance with these Terms and all program policies.


Participants Under Age 18
Participants under the age of 18 may only enroll and participate with the consent and involvement of a parent or legal guardian.


By enrolling a minor participant, the parent or legal guardian:

  • agrees to these Terms on behalf of the participant;

  • accepts responsibility for enrollment, participation, and financial obligations;

  • consents to participation in mentorship activities and online sessions;

  • confirms authority to enter into legally binding agreements on behalf of the minor.

We reserve the right to request proof of legal guardianship where reasonably necessary.

INDEPENDENT PROGRAM DISCLAIMER


Hitmaker Song Lab is an independent educational and mentorship program.


We are not affiliated with, endorsed by, sponsored by, or officially connected to any entertainment company, management company, music label, recording studio, artist, idol group, agency, or third-party entertainment business.


References to artists, music companies, producers, entertainment agencies, or commercial projects are provided solely for educational, informational, or descriptive purposes.


Participation in Hitmaker Song Lab does not guarantee:

  • entertainment industry opportunities,

  • auditions,

  • artist development contracts,

  • management,

  • trainee placements,

  • representation,

  • commercial music releases,

  • songwriting placements,

  • professional success,

  • or any specific artistic, financial, educational, or career outcome.

AUDITIONS & SELECTIVE ADMISSIONS

 

Participation in Hitmaker Song Lab requires submission of an audition application and supporting materials.


Auditions are mandatory and form part of our admissions and placement process.


Audition materials may include:​

  • vocal recordings,

  • performance videos,

  • songwriting samples,

  • lyrics,

  • demos,

  • original music,

  • interviews,

  • questionnaires,

  • or other creative submissions.

Submission of audition materials does not guarantee admission into Hitmaker Song Lab.

Acceptance decisions are made in our sole discretion and may be based on:

  • creative potential,

  • mentorship suitability,

  • artistic readiness,

  • participant commitment,

  • program capacity,

  • safety considerations,

  • and overall program fit.

We reserve the right to accept, decline, defer, or waitlist any applicant.

​

Audition Fees

Any audition application fee is non-refundable unless otherwise required by law.


Application fees cover administrative review, assessment, and admissions processing and are not contingent on acceptance.
 

USER REPRESENTATIONS

 

By using our website or Services, you represent and warrant that:

  • all information provided is truthful, accurate, and complete;

  • you are at least 18 years old or are participating with valid parental/legal guardian consent if under 18;

  • you will comply with these Terms and applicable laws;

  • you will not use our Services unlawfully or fraudulently;

  • you will not infringe upon the rights of others;

  • materials submitted by you are accurate and submitted in good faith.

 

We reserve the right to suspend or terminate access where information is false, misleading, unlawful, or materially inaccurate.

INTELLECTUAL PROPERTY RIGHTS​

 

Unless otherwise indicated, all website content, educational materials, branding, designs, curriculum, mentorship resources, graphics, videos, text, audio, downloads, trademarks, and related materials (“Content”) are owned by or licensed to Hitmaker Song Lab and protected by applicable intellectual property laws.


The Content is provided for personal educational use only.

 

You may not:

  • distribute,

  • commercially exploit,

  • modify,

CREATIVE WORK & CONTRIBUTIONS

 

Participants may create and submit original creative materials, including::

  • lyrics,

  • melodies,

  • demos,

  • audio recordings,

  • written work,

  • songwriting assignments,

  • performances,

  • and related creative content (“Creative Work”).​​

Ownership

Participants retain ownership of their original Creative Work.


Hitmaker Song Lab does not claim ownership of participant-created original songs, lyrics, or compositions.

​

Educational License

By submitting Creative Work, participants grant Hitmaker Song Lab a limited, non-exclusive, royalty-free license to use materials internally for:

  • mentorship,

  • feedback,

  • educational instruction,

  • program administration,

  • and participation purposes.

​

This license does not transfer ownership.

​

Originality Requirement

You represent and warrant that submitted materials are original or properly authorized and do not infringe upon third-party intellectual property rights.


Hitmaker Song Lab is not responsible for copyright disputes arising from participant submissions.


You agree to indemnify and hold harmless Hitmaker Song Lab from claims related to copyright infringement, unauthorized use, or ownership disputes involving submitted material.​

MEDIA, RECORDINGS & PUBLICITY

 

Hitmaker Song Lab will not publicly share participant work, likeness, recordings, names, testimonials, or creative materials without consent.


For participants under 18, parent/legal guardian consent may be required.


Separate written permission may be requested for marketing, testimonials, promotional materials, or media use.

 

PARTICIPATION EXPECTATIONS

 

Participants agree to engage respectfully and professionally during mentorship sessions.


We reserve the right to suspend or remove participants for:

  • harassment,

  • abusive conduct,

  • discrimination,

  • repeated disruption,

  • unlawful behavior,

  • academic dishonesty,

  • safety concerns,

  • or violations of these Terms.

 

Removal from the program does not automatically entitle a participant to a refund.

 

PROHIBITED ACTIVITIES

 

You may not access or use the website for any purpose other than that for which we make the website available.

 

As a user of the website, you agree not to:

  • Use the website for unauthorized or commercial purposes,

  • Upload harmful software, spam, or disruptive material,

  • Attempt to bypass security features,

  • Harass, intimidate, or harm other users,

  • Impersonate another person,

  • Collect information from minors without consent,

  • Use the website to compete with Hitmaker Song Lab.

 

Any violation may result in termination of access.

DISCLAIMERS

To the fullest extent permitted by law, Hitmaker Song Lab, its owners, contractors, mentors, staff, affiliates, and representatives shall not be liable for indirect, incidental, consequential, punitive, or special damages arising from:

  • participation in mentorship,

  • use of the website,

  • audition submissions,

  • creative disputes,

  • technical interruptions,

  • third-party platforms,

  • missed opportunities,

  • emotional distress,

  • or business or career outcomes.

 

Maximum liability shall not exceed fees actually paid to Hitmaker Song Lab in the twelve (12) months preceding the claim.

THIRD-PARTY SERVICES

 

The website may contain links to third-party websites, software, platforms, or services including, but not limited to, Zoom, Dropbox, Google Drive, YouTube, payment processors, or email providers.


Your use of third-party services is at your own risk and governed by those third parties’ policies.


We are not responsible for third-party content, security, policies, or service interruptions.
 

WEBSITE MANAGEMENT


We reserve the right to:

  • monitor the Site for violations,

  • restrict access to protect minors and program integrity,

  • remove inappropriate content,

  • take legal action when necessary.

  • participant submissions,

  • violation of these Terms,

  • violation of any third-party rights.
